The Council of the City of Waukegan met in special session on Thursday, November 18, 2010 at 7:00P.M. In the City Council Chambers, City Hall 100 North Martin Luther King Jr. Avenue. Mayor Sabonjian, City Clerk, Wayne Motley, and Corporation Counsel Newton Finn were present.

1.Motion by Alderman Figueroa, seconded by Alderman Rivera to approve of Memorandum of Understanding Concerning Potential Purchase of Real Estate between the City of Waukegan and the Board of Trustees of Community College District No. 532, involving the former News Sun site, NW corner of Sheridan and Madison.

Motion by Alderman Larsen, seconded by Alderman Cunningham to amend the language in the document in the sectioning following now there for owner and inspector agrees as follows; right of access subject to the terms of this agreement owner hereby grants to inspector and inspections agents, employees, consultants, contractors, sub contractors or other reps collectively the inspectors agents from and after the date of this agreement for a period ending 5:00 p.m. Chicago time February 18, 2011 which will be changed to March 18, 2011 or until this agreement is terminated by either party

4. Motion by Alderman Rivera, seconded by Alderman Koncan to approve and ratification of an interim agreement between Field Crest Developers and the City of Waukegan regarding site preparation and storage at the property immediately north of the Kmart at 3110 Belvidere Road.

TO APPROVE TEMPORARY MODIFICATION FOR THE CITY’S LOCAL HIRING ORDINANCE

5. Motion by Alderman Koncan, seconded by Alderman Rivera to approve temporary modification of the city’s Local Hiring Ordinance to reduce the percentage of local hires to 10% for projects now being or about to be put out for bid, pending further council action.

CORPORATION COUNSEL EXPLAINED THE MODIFICATION TO THE HIRING ORDINANCE

6. Corporation Counsel, Newton Finn indicated that in order to modify the local Hiring Ordinance the city must indentify one of five reasons for doing so prior to making such modification, the reasons are: 1. Emergency 2. Highly specialized contracts 3. Contracts that are subject to laws, regulations or policies that prohibit local hiring 4. Contract under an Intergovernmental Agreement 5. Situations where application of the requirements of this section might violate the law, unduly deter potential bids in Public Work projects or create problems with a Public Works project start up, progress and completion. It was Mr. Finn’s opinion that the reason that the City Council could amend the Local Hiring Ordinance at this time is #5.

8. Motion by Aldermen Larsen, seconded by Alderman Figueroa to determine that the City of Waukegan’s 2010 Aggregate Property Tax Levy will probably be more than 5% higher than the prior year’s aggregate tax extension.
