In December 2002, the City of Waukegan made three additions to the Ordinance Chapter 15 Section 15-45.2 which allows for the seizure and impoundment of motor vehicles for various offenses.
(1) Driving under the influence of Alcohol and Drugs.
(2) Driving while license is Suspended of Revoked.
(3) Driving an uninsured motor vehicle.
(4) Driving a motor vehicle without insurance
When a vehicle has been seized under section 15-45.2, a $500.00 seizure penalty is placed on the vehicle.
If the owner of record or person found to be in control of the vehicle waives the right to a hearing and pays the $500 penalty, and all towing and storage fees, the vehicle will be released.
The Owner of record or person found to be in control of the vehicle may request a hearing within 30 days of the seizure of the vehicle of the vehicle. The request must be in writing to the Waukegan Police Department. And a $500.00 seizure bond must be posted. Within seven days of receiving a written request for a hearing, a hearing shall be held before a hearing officer.
If no request for hearing is received within 30 days and the seizure penalty has not been paid, the vehicle will be deemed abandoned and disposed of in the manner provided by law.
